Но, как все видят, уже позиция России изменилась, они вероятно вообще не пойдут против ВАДА доказывая, что Милдронат не допинг, как говорили и обещали 2-3 недели назад.
Всегда было так, всегда отказывались бороться с ВАДА и поэтому ВАДА делает то, что хочет.
А потом те же самые, которые отказались бороться, начинают жаловаться от действия ВАДА

А почему нет?
Если в Трибунал будут люди как я, они будут принципиально против ВАДА - нельзя в никоем случае менять правила по середину процесса и принимать валидными признания, документы и защиту, которые обвиняемые подготовили исходя из предыдущих правил.
Я например заявил бы, что рекомендации ВАДА незаконные, как незаконные и все ее правила для мельдония, потому что сама ВАДА доказала, что не знает (еще не знает в середине апреля 2016 года!) как Мельдоний работает в организме спортсмен!
Второй пункт - нельзя менят правила в пользу одних спортсмен и в ущерб других, по середину процесса. Спортсмены не виноваты. И голосовал бы, против признания любого допингово теста Мельдония за антидопинговое нарушение. Мы еще не знаем как будут реагировать членов Трибунала на последних событий. Их реакция может быть очень отрицательной к ВАДА. Это люди специалисты, они ставят свое имя, рискуют свой престиж, это не политики или спортивные руководители, которые очень мало понимают в законах.
Я не понимаю, почему все думают Трибуналы будут следовать то, что ВАДА написала вчера. Это только рекомендации. Таким образом ВАДА "умыли свои руки" и пытаются перебросить ответственность федерациям и Трибуналам. Но там есть умные люди и не ясно как они воспримут эти "рекомендации".
Законы и правила надо быть одинаковые для всех. Если меняете правила по середину соревнования, что за честное соревнование будет это?
Скажем прыжки в длину. Сейчас длина разбега не ограничена. Но если вдруг меняем правила по середину Чемпиона Мира и говорим "не больше 25 метров" и признаем только результатов тех, чей забег был 25 метров или меньше, это по Вашему ОК?

ITF statement regarding the case of Maria Sharapova
PRESS RELEASE
In light of the recent notice from WADA regarding the process for dealing with cases involving meldonium, the ITF can confirm that the Tennis Anti-Doping Programme case involving Maria Sharapova will proceed to a hearing in accordance with WADA’s recommendations.
The ITF does not intend to make any further statement until completion of this process due to the confidentiality of the Tennis Anti-Doping Programme.

Defense lawyer Howard Jacobs
’The Athletes Lawyer’
Jacobs first became exposed to doping issues in the late 1980s when he worked for USA Triathlon.
He was introduced to people from the United States Olympic Committee, and helped out on a case just before the Olympics in Salt Lake City.
After receiving a good result, Jacobs was hooked.
"I spent a lot of time in the early years sort of reviewing and learning the science of the tests and getting to where I understood it," Jacobs said from his office in Westlake Village. "Most lawyers for whatever reason don’t bother to learn it. They just somehow think they can do the case without understanding the science behind it, which I think is impossible."
Born in Pittsburgh and raised in Florida, Jacobs always had an interest in nutritional supplements stemming from his own athletic prowess.
He participated in track and cross country at Florida State and competed as a professional triathlete while attending William & Mary law school in Virginia.
"There was a definite carry over from my athletic days to being interested in this subject," Jacobs said. "I think as an athlete you are always reading up on things people are taking. I can’t say I took a lot of the stuff, but I knew about it."
The fit and trim Jacobs has billed himself as "The Athletes Lawyer," and is in better shape than some of the clients he represents.
He has won nearly every local running race over the years, and squeezes in workouts whenever possible.
His office is located only two miles away from his home in Westlake Village, where he lives with his wife, Stephanie, and their two children ? daughter Polly, 14, and son Ned, 10.
"Ideally, I would run three to four times a week, bike three times a week and swim three times a week," he said. "But I haven’t swam in over a month because it became impossible time wise. I mostly like the running and the trails around here are great. I usually head out for a run after I drop my son off at school in the morning. That is what makes this location perfect for me."
Although Jacobs was already immersed in the doping field, his expertise gained more national attention once the Bay Area Laboratory Cooperative (BALCO) scandal erupted in 2003.
"That kind of changed everything both for me and for doping cases generally because there was a huge national spotlight on all the BALCO cases," said Jacobs, who estimates two-thirds of his practice is related to sports issues and the other third to catastrophic injury cases. "I ended up doing most of the Balco cases in the Olympic movement in the United States at least."
Jacobs briefly represented Jones in 2006 when the Thousand Oaks High graduate tested positive for erythropoietin (EPO). The disgraced track star’s case ended in dismissal when her "B" sample was negative.
"Sometimes you get unfairly blamed when an athlete gets suspended and sometimes you get unfairly credited when an athlete gets cleared," Jacobs said. "That is maybe a case where I got more credit than I deserved. All I did was hire an expert and have that expert attend and that was it."
Two years later, Jones pled guilty to lying to federal agents about her use of performance-enhancing drugs and her connection to a check fraud case. She sent Jacobs a copy of her book once she was released from federal prison.
"She made some bad choices and got mixed in with some people she probably shouldn’t have been associated with," Jacobs said. "She seems from my interaction with her to be a very smart person and very sincere. Hopefully, she can move on and make the best of her situation."
Believing in clients
Although many cynics have come to believe all athletes accused of doping are guilty, Jacobs takes his clients at their word.
"There have been athletes over the years where the facts come out and they said, ’Yeah. I took it,’ " Jacobs said. "But almost all the clients I have represented usually come to me and the first thing they say is ’I tested positive for this substance and I don’t know what it is. I never took it.’ I think by and large athletes that want to cheat and have the means, can. If they have the resources and the desire, they can hire somebody to learn how to evade the test. I think people who are really trying to cheat almost never get caught."
Jacobs says many of the positive tests he defends are the result of contaminated substances or an athlete taking asthma medication or medication for attention deficit disorder.
"In most cases I do in the Olympic movement it’s about explaining how the positive happened and how the athletes did not want to cheat," he said. "I am representing them in a way to get the shortest possible repercussions so their career is not ruined."
Jacobs didn’t have enough time to save Zach Lund. The skeleton racer was banned from the 2006 Olympics because of a positive test from using an anti-balding medication.
"That was a hard case to be involved in because it was so obvious he hadn’t done anything wrong and everybody felt bad for him,

Денни, автор прочел Ваши мысли и задает такие же вопросы, как и Вы. И что-то мне подсказывает, что именно такие вопросы и будет задавать адвокат Маши.

Но ведь в данном случае правила поменяли в сторону облегчения - у кого низкая концентрация мельдония могут освободить от наказания или существенно его снизить. Возможно у Маши тоже низкая концентрация и она сможет избегнуть наказания.
Ну то бы там не было кажется до начало РГ мы узнаем уже решение трибунала (моё мнение )
